What is Legal Aid Mediation?
Legal aid mediation is a government-funded service designed to help individuals resolve disputes outside of the courtroom. Instead of a judge making a decision, a neutral Family Mediator helps both parties reach an agreement that works for everyone.
The Benefits
Cost-Effective: If you qualify, the mediation sessions and the resulting legal paperwork are free.
Faster Results: Avoid the months-long (or years-long) backlog of the court system.
Less Stress: Mediation is collaborative, not adversarial. It’s about finding solutions, not “winning” an argument.
Confidentiality: Unlike court hearings, which are often public, mediation happens behind closed doors.
Do I Qualify for Legal Aid?
Eligibility is primarily based on your financial situation. Generally, to be eligible for free mediation, you must demonstrate that you have a low income and limited savings.
| Factor | What is Assessed? |
|---|---|
| Income | The easiest way to qualify for Legal Aid is via income related benefits such as Universal Credit or ESA. You can also qualify if you have low income by providing bank statements for assessment. |
| Capital | Your savings, investments, and any equity in your home. |
| Case Type | Usually reserved for family law (divorce, child custody, financial settlements). |
Even if only one party qualifies for legal aid, the Mediation Information and Assessment Meeting (MIAM) and the first full mediation session are free for both parties.

How the Process Works
The MIAM: You meet with a mediator to see if mediation is right for your situation.
Assessment: The mediator checks your financial evidence to confirm if you qualify for legal aid.
Joint Sessions: You and the other party meet (separately or together) to discuss and negotiate.
The Agreement: If you reach a consensus, the mediator drafts a “Memorandum of Understanding” or a parenting plan which can be turned into a legally binding order.
